ORAL ORDER
1. Learned
Assistant Government Pleader Ms. Maithili Mehta submitted that this Court passed order dated 27.12.2010 which is to the effect that, "Under the circumstances, respondents are directed to take a final decision involving all these issues and place before the Court along with further reply in all these petitions before the next date."
1.1. Learned Assistant Government Pleader submitted that as the matter pertains to determining the policy is lying with the Hon'ble the Chief Minister and it is likely to take one month in getting finalized.
2. Learned
advocate Mr. B.S. Patel in Special Civil Application No.15144 of 2010, submitted that, as submitted in para 3.7 of the petition, 'there are 621 schools which do not have got Principals and the schools are running without Principals'. He also pointed out that, 'there are vacancies of 3130 secondary teachers and 1950 higher secondary teachers and 55 Library Assistant Teachers and 220 Librarian posts are vacant and Clerks and Peons which are required to be recruited are also large in number'. 2.1. Learned advocate for the petitioner submitted that assuming for the sake of argument that some policy is required to be formulated for recruitment of teachers on account of shifting of 8th Std. from secondary section to primary section, there is no reason not to grant NOC for recruitment of Principal, Higher Secondary Teachers, Library Assistant Teachers and Librarians and last but not the least, Clerks and Peons.
3. That
being so, learned Assistant Government Pleader is granted time till Tuesday to make clear the stand of the Government with regard to recruitment of Principals, recruitment of Higher Secondary Teachers, recruitment of Library Assistant Teachers, recruitment of Librarians and recruitment of Clerks and Peons. The
matters is adjourned to 25th January 2011.

of this order be made available to the learned Assistant Government Pleader for its onward communication. (RAVI
